THE COMEDY SMALLS Awards 2009 (THE SMALLS™) - Terms and Conditions
Introduction
These are the terms and conditions upon which each Entry to the THE COMEDY SMALLS Awards shall be subject. If The Smalls (“we,” “us,” “our,” or “THE SMALLS”) accept an entrant’s (“you,” “your,” “yourself” or “entrant”) Entry, you will be bound by these terms and conditions and your Entry shall be considered and judged in accordance with these terms. We reserve the right to amend these terms and conditions at any time and such changes shall be deemed notified to you by their publication on the Website.
Definitions
1. The following terms shall have the following meaning in these terms and conditions:
‘THE COMEDY SMALLS Awards’ means the competition known as the THE COMEDY SMALLS Awards whereby short films are judged by THE SMALLS and judging panel and awards are given.
‘THE COMEDY SMALLS 2009 Awards Night’ means a date to be confirmed (or any other date as notified on the Website)
‘Closing Date’ 13th Nov 2009.
‘Entry’ means your submission to be considered for entry in the THE COMEDY SMALLS Awards.
‘Entry Criteria’ means the format entries must be submitted in and comply with as follows: a short film maximum 5 minutes in length, either to be uploaded on site (www.TheSmalls.com) or supplied on CD/DVD, in Quicktime or m4v format, interpreting the Theme. Please note that for your film to be eligible for short-listing you need to be able to provide your entry film as a Quicktime file with 720 x 576 resolution and 4:3 aspect ratio for TV use. Your Entry must not, without the appropriate release forms signed which need to be submitted as part of your application, contain any material not originated or created by you, including music, photos & images and your entry must not be defamatory of, infringe the rights or privacy of any person or contain anything else that is unlawful.
‘Theme’ is ‘Travel’.
‘Entry Form’ means the form completed by you in order to participate in THE COMEDY SMALLS Awards.
‘Judging Criteria’ means the criteria and bases for judging Entries and granting awards to Entrants in the course of the THE COMEDY SMALLS Awards. The Judging Criteria is: Idea, Execution and Interpretation of the Theme.
‘Website’ means the THE SMALLS website accessible at www.thesmalls.com
THE SMALLS Awards Entry Formalities
2. All Entries must be submitted in the English language using the Entry Form available on the Website and the Entry must be accompanied by your name, telephone number, address, e-mail address and the title of the Entry. Each Entry must relate to the specific Theme and must be submitted to THE SMALLS adhering to the Entry Criteria and otherwise in accordance with these terms and conditions. By submitting an Entry you confirm that you accept these terms and conditions.
3. Each Entry must be completed in full and received by THE SMALLS on or before the Closing Date. Entries received after the Closing Date will be disqualified and will not be considered by THE SMALLS. Entries which are not fully functional will be disqualified by THE SMALLS at its sole discretion.
4. By submitting your Entry, you warrant that your entry is your OWN ORIGINAL WORK or that you have the right to make it available to THE SMALLS for all purposes stated in these terms and conditions.
5. In the event that an Entry is inaccurate or incomplete, does not comply with these conditions for entry or is deemed, at the sole discretion of THE SMALLS, ineligible for any other reason, then the relevant Entry will be disqualified.
6. No Entry will go forward for judging unless a completed Entry Form has been submitted with your Entry.
7. The Entrant may provide a brief synopsis of the entry, together with an inspiration statement. In the event that the Entrant wishes to submit such additional descriptive information, this should be included within the entry form when submitting the Entry. Further information relating to an Entry shall not be admissible after the Entry is submitted.
8. Neither Entries nor any accompanying information will be returned to you unless you make acceptable arrangements with the THE SMALLS office prior to the judging of the relevant Entry. A return envelope with postage paid must be provided.
9. You may submit any number of Entries to the THE COMEDY SMALLS Awards but it is important that each entry is given a unique title and submitted with its own Entry Form.
10. Anyone under the age of 18 must have a parents signature of consent.
Judging Entries
11. THE SMALLS shall consider each Entry initially on its merits on the basis solely of the information referred to in the relevant Entry as it best meets the Judging Criteria.
12. Judging will take place in November 2009 or as otherwise decided by THE SMALLS.
13. THE SMALLS initial round of judging will select certain Entries to go through to the final judging phase for short-listing and winner selection by the Judging Panel, which shall be formed of leading industry figures (exact panel to be confirmed prior to Judging). Entrants shortlisted shall be invited to attend the THE COMEDY SMALLS 2009 Awards Night presentation ceremony on a date to be confirmed. Final awards will be announced by THE SMALLS at the Awards Night from the short-list.
14. THE SMALLS’s decisions relating to short-listing and granting of awards in the course of judging the THE SMALLS Awards is final and THE SMALLS will not enter into any correspondence or discussion with any Entrants on any subject nor will THE SMALLS accept any submissions or representations or appeals with regard to such decisions, and THE SMALLS reserves at its sole discretion the right to disqualify Entries which do not comply with these conditions or for any other reason.
15. The overall winner will be invited to pitch their winning Entry idea to G.O.L.D.’s commissioning team over lunch one day during the week commencing 11th January 2010. Exact date and time to be agreed with winner subject to the G.O.L.D. teams availability.
Limitations and Disclaimer
16. THE SMALLS will not be responsible or liable, financially or otherwise, in respect of any malfunction or any other event related in any way to an Entry or the judging procedure.
17. THE SMALLS accepts no responsibility, financial or otherwise, for:
any promise or indication made public before an Award is formally announced;
any damage whatsoever caused by any actions taken by THE SMALLS in relation to any particular Entry including damage to any Entry.
18. In no event shall we be liable to you whether in contract, tort, by statute or otherwise in respect of any loss of profits and/or loss of business for any special, indirect, incidental or consequential loss or damage arising out of or in connection with the THE COMEDY SMALLS Awards, including without limitation: loss of revenue, loss of anticipated savings, loss of business and/or goods, loss of goodwill, loss of use, loss and/or corruption of data and/or other information, including as a result of loss or damage caused by or to Entries.
19. Nothing in these terms and conditions shall exclude or restrict our liability for fraudulent misrepresentation and/or for death or personal injury to the extent that such injury results from our negligence or willful default.
20. For the avoidance of doubt, you agree and accept that you will be solely responsible and liable for any and all damage caused by your Entry submitted to THE SMALLS therewith.
If Your Entry Has Been Short Listed
21. You will be informed whether your Entry has been short listed during November 2009 via a notification on the Website, via email or phone. Any changes to this timescale shall be posted on the Website from time to time.
22. You will be required to supply screenshots and other information reasonably requested by THE SMALLS to THE SMALLS for use for display during THE COMEDY SMALLS 2009 Awards Night. You will also be required to provide a high-resolution copy of the film as a Quicktime file with 720 x 576 resolution and 4:3 aspect ratio for TV use. You grant and authorise THE SMALLS and its associates by form of perpetual, irrevocable, royalty-free, non-exclusive licence to show all and any Entries, screenshots and other information provided to THE SMALLS to use and reproduce on their respective TV channels, websites, mobile channels, on DVD and in print.
23. It is your responsibility to ensure that you have secured such permissions as are required in respect of third party rights and materials in the Entry to ensure compliance with clause 22 above.
Governing Law
24. These terms and conditions shall be interpreted in accordance with and governed by English law.
