Please read The Smalls Film Festival 2013 Official Rules. By submitting your film to The Smalls Film Festival 2013 you accept these rules.

These are The Smalls Official Rules (the “Official Rules”) of The Smalls Film Festival 2013. The Smalls Film Festival honours the world’s best short films and the talented filmmakers that create them.

One film from each competition category will be awarded as the winner, with the creator(s) receiving a prize (to be announced by July 2013). The best short film overall, selected from all entries, will be recognized as the Grand Prize winner of this year's festival. This portion of The Smalls Film Festival is referred to as the “Contest.” By entering the Contest, you accept these Official Rules.

1. ELIGIBILITY

The Contest is offered and open only to natural persons who are at least the age of majority of the jurisdiction of their residence at the time of entry. The following persons are not eligible to enter the Contest: the Contest judges.
THE CONTEST IS VOID WHERE PROHIBITED.

2. PROMOTIONAL PERIOD

You must submit a short film (a “Submission”) that complies with the Requirements of Section 4 below between 22nd April 2013 and 8th July 2013 (the “Submission Period”) using the means described below. Entries will be judged between the 9th July and 12th August 2013 (the “Judging Period”). Awards will be announced at The Smalls Film Festival Awards on 6th September 2013.

3. HOW TO ENTER

To enter the Contest, you must be a member of The Smalls (to become a member of The Smalls, you must register with The Smalls, which you may do at www.thesmalls.com). You must pay an entry fee for each Submission that you submit (the “Entry Fee”). The Entry Fee for The Smalls members is £10 during the Early Bird Submission Period, £18 during the Regular Submission Period, and £22 during the Late Submission Period. THE ENTRY FEE IS NON-REFUNDABLE. YOU WILL NOT BE REFUNDED FOR ANY REASON INCLUDING DISQUALIFICATION.

To enter your Submission, you must complete in the entry form and agree to the Terms and Conditions of The Smalls, as seen on www.thesmalls.com.

To enter the Contest by mail or courier, you must contact The Smalls Film Festival 2013 at festival@thesmalls.com to receive an entry form and further instructions on how to submit. You then submit our entry form, a copy of your Submission on a CD/DVD, and a cheque payable to The Smalls for the Entry Fee to the following address:

The video file that you submit must comply with The Smalls recommended
compression and uploading guidelines, which can be found in the Terms and Conditions.

Once you have entered a Submission, it will not be returned. Submissions may be disqualified at any time for non-compliance with these Official Rules. The Smalls makes the final determination as to which Submissions are eligible to take part in this Contest and be considered for a prize or award. The Smalls will not notify you of any disqualification or the reasons for such disqualification.

ANY ATTEMPT TO ENTER THE CONTEST EXCEPT AS PROVIDED ABOVE IS VOID.

4. REQUIREMENTS AND JUDGING CONSIDERATIONS

4.1 GENERAL
Each Submission must comply with the following rules:

  • It must be an original work by you, meaning that you were one of the work’s principal creators and have the right to submit it to The Smalls and grant the licenses set forth in Section 6.
  • It must be in the English language or have English subtitles (to the extent it contains dialogue or text).
  • It must fall into one of the “Categories” set forth in Section 4.2 below and comply with all Category-specific length and content requirements. (The Smalls reserves the right to move the Submission to a different Category or disqualify the Submission if it is submitted to the wrong Category).
  • The Submission must not be an excerpt from a longer work.
  • It must comply with all of the content restrictions set forth in Section 5. Among other things, ANY USE OF THIRD PARTY MUSIC IN THE SUBMISSION MUST BE PRE-CLEARED WITH THE APPLICABLE OWNERS/LICENSORS.
  • You must have the right to grant the licenses set forth in Section 6.

The Smalls is seeking Submissions that:

  • Express creativity and vision
  • Are well crafted and executed
  • Showcase great storytelling ability and/or create an emotional resonance.

Submissions will be judged based upon the above considerations (the “Overall Considerations”) and the Category-specific considerations set forth in Section

4.2 (the “Category Considerations”).

    Judging considerations: Idea, execution and script and/or creative direction that brings music and video together in a creative way
  5. Animation
    Maximum Length: 15 minutes
    Judging considerations: Idea, execution and script
  6. Foreign Language Film
    Maximum Length: 15 minutes
    Judging considerations: Idea, execution and script

5. CONTENT RESTRICTIONS

Your Submission must comply with the content restrictions and guidelines in The Smalls Terms and Conditions (www.thesmalls.com/festival).
In addition and without limiting the generality of the foregoing, the Submission must also comply with the restrictions below:

  • The Submission may not contain obscene or pornographic material; contain threats to any entity, place, group, or world peace; or violate any applicable laws.
  • The Submission may not infringe any third party’s intellectual property
    rights or infringe any third party’s privacy rights.
  • The Submission must not contain any third party work, INCLUDING ANY
    MUSICAL RECORDING OR COMPOSITION, unless (1) you have a license to use such work in the Submission from the owners/licensors; (2) such work is in the public domain; (3) your use of such work is clearly “fair use” under United Kingdom copyright law.
  • Where required by law, you must have obtained appropriate releases for every person who appears recognizably in your Submission.
  • No live animals may be used in the creation of a Submission unless you have obtained the consent of the animal’s owner and an affidavit from the animal owner or wrangler stating that the animal was not harmed in the making of the Submission. We encourage you to contact the local Humane Society prior to filming the Submission to verify appropriate animal safeguards on set.
  • You must not breach any contractual obligation in submitting your Submission.

You must provide any licenses, permissions, or releases to The Smalls upon request.
Failure to provide such documentation or comply with any the foregoing requirements (in The Smalls’ sole determination) may result in the disqualification of your Submission.
By entering your Submission, you represent and warrant that it complies with the
requirements set forth in this Section 5.

6. GRANT OF LICENSE

As between you and The Smalls, you will own all intellectual property related to your Submission and shall retain ownership of such intellectual property. By submitting your Submission, you grant The Smalls a non-exclusive, worldwide license to use, publicly perform, display, reproduce, transmit, sublicense, and distribute in all media formats that exist now or in the future the Submission on The Smalls in connection with (1) the Contest and the promotion of the Contest; (2) the promotion of future iterations of The Smalls Film Festival; and (3) the promotion of the The Smalls Website (collectively, the “License”). The License shall commence on the date you submit your Submission to The Smalls and shall continue in perpetuity. You may revoke the License at any time by providing The Smalls with written notice to info@thesmalls.com provided, however, that if your Submission is selected as a Finalist before you provide such notice, the license shall become non-revocable.

The License is in addition to any license granted by you in The Smalls Terms and Conditions. The Smalls will not use your Submission for commercial purposes without your permission except as expressly set forth above. All rights not expressly granted by you with respect to your Submission are reserved.

By entering your Submission, you represent and warrant that you have the right to grant the licenses set forth in this Section 6.

7. INDEMNIFICATION

You shall indemnify, defend, and hold The Smalls harmless from any losses arising from any third party action (a) asserting a breach by you of any representation, warranty, or obligation in these Official Rules; or (b) asserting that your Submission infringes or violates any law or any third party right, including any intellectual property right.

8. JUDGING AND AWARDS

The Smalls will select qualified individuals to review all qualifying Submissions and create a shortlist of Submissions for each Category based upon the Overall Considerations and the Category Considerations. The entrant of each shortlisted Submission shall be referred to as a “Shortlisted Entrant’. To be eligible to be a Shortlisted Entrant, you must not have revoked the License set forth in Section 6. Upon The Smalls’ request, each Shortlisted Entrant must provide The Smalls with any documentation reasonably requested by The Smalls (e.g., licenses, releases, photos, bios, etc.). Failure to do so in a timely manner may result in disqualification. Each group of Shortlisted Entrant Submissions for a particular Category will be judged by an expert panel of judges selected by The Smalls (a “Jury”). Each Jury member will assign a single score to each Shortlisted Entrant’s Submission based upon the Category Considerations and the Overall Considerations. The top Shortlisted Entrant Submissions for each Category will be deemed “Finalists.” The Jury members will discuss the Finalists to determine which Finalist will be the winner of the Category. In doing so, the Jury may consider community voting and commentary on the Finalists, which shall be provided to the Jury by The Smalls. Each winning Finalist will be deemed a “Category Winner” and will be awarded a Category award (each, a “Category Prize”). A panel of judges selected by The Smalls from multiple Juries (the “Grand Jury”) will discuss the Category Winners to determine the best overall Submission based upon the Overall Considerations. The person who submitted this Submission (the “Grand Prize Winner”) will be awarded the “Grand Prize.”

9. PRIZES

Each Category Winner will receive a Category Prize (to be announced by July 2013)

The best short film overall, selected from all entries, will be recognized as the Grand Prize winner of this year's festival.

Each Winner will be required to enter into an agreement with The Smalls that sets forth the terms of the grant (which shall be consistent with the terms herein).

No prize transfer, assignment, or substitution by any Winner is permitted. TAXES ARE THE SOLE RESPONSIBILITY OF THE WINNER. The winner will be subject to the income tax rules of the UK or his or her country of origin. The winner will cooperate with any tax inquire from The Smalls.

10. RELEASES

The Smalls may require each Winner to complete, execute, and return an Affidavit of Eligibility, a Liability Release, and where lawful, a Publicity Release, as well as certain other documentation reasonably requested by The Smalls, within two (2) days of first attempted notification. Failure to respond to The Smalls in a timely manner or failure to return documents in a timely manner may result in disqualification with an alternate winner selected. Where permitted by law, each Winner agrees to grant to The Smalls and those acting pursuant to its direction or control, the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, his or her name, portrait, picture, voice, likeness and biographical information as news or information and for advertising, trade and promotional purposes without additional consideration, and without notification, review, or approval.

The Smalls may require each Winner to make publicity appearances. Failure to make such appearances or grant such rights may result in disqualification with an alternate winner or potential winner selected; and while not obligated to do so, The Smalls may in its sole discretion, bear such reasonable costs and expenses which The Smalls, in its sole discretion, deems appropriate for Winners or potential winners to appear for a presentation or other activity.

By accepting any prize or award, each Winner agrees that any Affidavit and/or Releases, and any grant of permission to use his or her name, portrait, picture, voice, likeness and biographical information, as stated above, may be secured by The Smalls electronically, for example but not limited to, by email or by facsimile, and such secured Affidavit and/or Releases and permission will have the same force and effect as if any of them had been secured in a written document which was executed by such person.

Further, by accepting any prize or award that each Winner releases and agrees to hold harmless the Contest Parties from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in any Contest related activity, or participation in this Contest.

11. PROHIBITED CONDUCT

The Smalls reserves the right, in its sole discretion, to disqualify any individual it finds, in its sole determination, to be tampering with the entry process or the operation of the Contest or The Smalls Website; to be in violation of The Smalls Terms and Conditions; to be acting in violation of the Official Rules; to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry methods will void all Submissions or votes submitted by such methods and persons using any such methods (in The Smalls’ sole determination) will be disqualified.

ANY ATTEMPT BY YOU TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SMALLS RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES) FROM
ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

If for any reason this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of The Smalls, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, The Smalls reserves the right to cancel, terminate, modify or suspend the Contest, and award the prizes from among entries received prior to such action to the extent feasible. If the Contest is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at the
Contest Webpage.

12. LIMITATIONS OF LIABILITY

The Smalls assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Smalls is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by The Smalls on account of technical problems, human error or traffic congestion on the Internet or the The Smalls Website, or any combination thereof.

The Smalls is not responsible for any incorrect or inaccurate capture of information or the failure to capture such information, whether caused by The Smalls Website users, tampering or hacking, or by any of the equipment or programming associated with or utilized in the Contest and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the web site. The Smalls is not responsible for injury or damage to any person’s computer arising from or relating to participation in this Contest or viewing or downloading materials from The Smalls Website.

IN NO EVENT WILL THE SMALLS OR ITS PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THIS CONTEST, ACCESS TO AND USE OF THE SMALLS WEBSITE OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SMALLS WEBSITE, INCLUDING THE CONTEST IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

13. DISPUTES; MANDATORY ARBITRATION

The Smalls’ decisions on all matters relating to this Contest are final and binding in all respects. In the event an entrant wins an award for a Submission that was created or submitted by more than one person, The Smalls may take any action regarding the award, in its sole discretion, including but not limited to, disqualifying the Submission outright, making the awards to one creator and not any other, making a joint award, or, in the case of a Category Prize or the Grand Prize, depositing the funds into an escrow account for the creators to decide how to resolve their dispute. Except where prohibited, as a condition of participating in this Contest, you agree that any and all disputes which cannot be resolved between the parties (you and The Smalls), claims and causes of action arising out of or connected with this Contest, or any prizes awarded, or the determination of the Grand Prize Winner shall be resolved individually, without resort to any form of class action exclusively by arbitration pursuant to the commercial arbitration rules of the London Court of International Arbitration, then effective. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for exemplary, treble, punitive, incidental, or consequential damages, or any other relief, including attorneys’ fees, other than your actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and you waive all rights to obtain such relief. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and The Smalls in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the United Kingdom without regard to principles of conflicts of laws, and all proceedings, including proceedings to enforce this provision, shall take place exclusively in London, England.
